Great find Rick!!

I just read the entire article, and it is very readable to non-lawyers like myself.

The article was written in 1965 and it was mostly focussed on the issue of racial discrimination. It's interesting to read the mainstream thoughts on that issue back in 1965, and to see how they have evolved to where we stand now.

As you pointed out in your quote, I believe that there are significant aspects of USHPA (and certainly the Torrey Pines Gliderport) that fall into the "state action" domain. This is especially true with the virtual monopoly that USHPA holds on flight at many otherwise public facilities on public land.

I have hoped that this issue might be resolved without resorting to the courts, and I was hoping that Ken might be instrumental in that outcome. But Ken's abandonment of the matter makes it clearer than ever that legal intervention might be needed. Please continue to post any other related articles, and thanks for posting this one!!!

As this 1965 article demonstrates, justice is an evolving effort. Thanks for your help in that evolution!!

Hopefully no one will come to the conclusion that the U$hPA banishment was part of an effort to prevent citizens of Polish-American descent from participating in activities related to the municipality of San Diego.

As documented in this topic, I began appealing to Ken Andrews to correct USHPA's retaliation around the time of his election to the USHPA Board. It's been about 4 years now, and Ken Andrews is now USHPA's Secretary and a member of their "Executive Committee". Here's Ken's current "profile" on USHPA's web site:

My name is Bob Kuczewski (USHPA #81898), and I am writing to request a confirmation that my expulsion from USHPA in 2015 remains in effect to this day (November 29th,2019). I have attached USHPA's 2015 notice of expulsion for your reference.

Please note that I applied for and obtained a 30 day membership from a USHPA instructor in February of 2019. The instructor was aware of the expulsion, yet he felt justified in issuing the 30 day membership anyway. He later informed me that he was subsequently contacted by USHPA and explicitly told to NOT issue any further 30 day memberships to me.

Please also "reply to all" with your response. I have included a number of policy makers in the copy address list and I would like it to be clear to them that I remain unable to use public land because I was expelled from USHPA for the reasons cited in the attached letter. These reasons include:

       - Starting an organization to potentially compete with USHPA
       - Testifying as an expert witness in a personal injury case
       - Speaking to the San Diego City Council about Torrey Pines

O.K. kennith, you believe in a United "free flight community", as you sit there in your "safe space" L Z. and refuse a "landing permit" to a very competent pilot. Your "Collective FBO" is stuck on the ground. You are an outstanding organization, although I think that YOU, (as a hang glider pilot) are "out....standing on the ground"......betraying "certain" fellow free heart flyers. (And I have no doubt that Your heart is flying free while you are in the air) But somehow it changes after you've folded .....................up Your glider. Your "ground" is quick sand, and I personally wish it was "quicker".

https://m.youtube.com/watch?v=EVxbsRMGPbg years have gone by, elections have been messed with, government and city council have gone dark, hate and animosity have taken over to the point that due process and civility have been thrown away. The bureaucracy and the "deep state" is relegated to a pile of blank paper, that they say has meaning.
The "squad" has infiltrated one of the best cities in the Country, and will never "allow" a conservative viewpoint. They have taken over a very very historic glider port. Pilots since 1930 have come here from all over the world to "fly", but because of a corrupted "business model", only paying "passengers" and "picnics" are pampered to now, and "Sailplanes" have been squashed to the bottom of a pile of aluminum tube and dacron. This glider port is on the National Historic Register for a reason, and it's not for the reason to take money consume massive amounts of not dogs.
Bravo to those who have stood (and are now seated), and to those few that are still standing every day, To put this "gold standard" of glider ports back into good standing with pilots and their familys, and put "slopping" down not dogs and cigarettes on the "low list".

As we stand here today, in November of 2021, Ken Andrews is no longer on the USHPA Board. His chance to make things right at Torrey has passed. The stain of his inaction cannot be erased. Let's hope Steve Pearson can learn something from the sad legacy of Ken Andrews.
