‘Indefinite Detention’ Bill Passes Senate 93-7

Americans completely stripped of all rights under Section 1031

The Senate last night codified into law the power of the U.S. military to indefinitely detain an American citizen with no charge, no trial and no oversight whatsoever with the passage of S. 1867, the National Defense Authorization Act.


One amendment that would have specifically blocked the measures from being used against U.S. citizens was voted down and the final bill was passed 93-7.

Another amendment introduced by Senate Intelligence Committee Chairman Dianne Feinstein that attempted to bar the provision from being used on American soil, an effort to ensure “the military won’t be roaming our streets looking for suspected terrorists,” also failed, although Feinstein voted in favor of the bill anyway.

Feinstein was able to include a largely symbolic amendment which states that “nothing in the bill changes current law relating to the detention of U.S. citizens and legal aliens,” but this measure is meaningless according to Republican Congressman Justin Amash, a fierce critic of the bill.

“Some have asserted that Sen. Feinstein’s amendment, S Amdt 1456, protects the rights of American citizens and preserves constitutional due process. Unfortunately, it does not. It’s just more cleverly worded nonsense,” Amash wrote on his Facebook page.

Not voting for the bill, or in other words upholding the oath to protect the Constitution, has been described over and over again as “political suicide”.

“The bill puts military detention authority on steroids and makes it permanent, American citizens and others are at greater risk of being locked away by the military without charge or trial,” said Christopher Anders, senior legislative counsel for the American Civil Liberties Union.

As Spencer Ackerman highlights,http://www.wired.com/dangerroom/2011/12/senate-military-detention/ the bill completely violates the sixth amendment in that it allows American citizens to be locked up indefinitely, including in a foreign detention center, without any burden of proof whatsoever. An American merely has to be declared a terrorist and they can be abducted off the streets and never seen again.

“The detention mandate to use indefinite military detention in terrorism cases isn’t limited to foreigners. It’s confusing, because two different sections of the bill seem to contradict each other, but in the judgment of the University of Texas’ Robert Chesney — a nonpartisan authority on military detention — “U.S. citizens are included in the grant of detention authority,” writes Ackerman.

National Defense Authorization Act: Provision Repeals Military Ban On Sodomy

WASHINGTON — Recently passed Senate legislation would make sodomy and sex with animals legal under military law, ending long-standing prohibitions and triggering cries of perversion from conservative groups.

The bill, which the Senate passed 93-7 last week, would repeal Article 125 of the Uniform Code of Military Justice that states any person who engages in "unnatural carnal copulation with another person of the same or opposite sex or with an animal is guilty of sodomy." Those found guilty of sodomy would be subject to court martial.

Despite reports that Obama is planning to veto the National Defense Authorization Act, Senator Carl Levin has revealed it was the administration itself that lobbied to remove language from the bill that would have protected American citizens from being detained indefinitely without trial.


“The language which precluded the application of Section 1031 to American citizens was in the bill that we originally approved…and the administration asked us to remove the language which says that U.S. citizens and lawful residents would not be subject to this section,” said Levin, Chairman of the Armed Services Committee.

“It was the administration that asked us to remove the very language which we had in the bill which passed the committee…we removed it at the request of the administration,” said Levin, emphasizing, “It was the administration which asked us to remove the very language the absence of which is now objected to.”

Section 1031 of the NDAA bill, which itself defines the entirety of the United States as a “battlefield,” allows American citizens to be snatched from the streets, carted off to a foreign detention camp and held indefinitely without trial. The bill states that “any person who has committed a belligerent act” faces indefinite detention, but no trial or evidence has to be presented, the White House merely needs to make the accusation.

An amendment introduced by Democratic Senator Feinstein, described as “cleverly worded nonsense” by Congressman Justin Amash, does not protect Americans from being subject to the provision.

“The Feinstein Amendment 1031(e) is dangerously misleading,” writes John Wood of Change.org [1], which is running a petition to oppose the signing of the bill. “Don’t be fooled: In the text of 1031(e), “Nothing in this section shall be construed…”, the only word that matters is “construed” because the Supreme Court are the only ones with the power to construe the law. The Feinstein Amendment 1031(e) permits citizens to be imprisoned without evidence or a trial forever, if the Supreme Court does not EXPLICITLY repeal 1031.”

The Obama administration never had a problem with Section 1031 of the bill and indeed acted to ensure it applied to American citizens. Doubts over whether or not Obama would veto the bill only arose out of issues with Section 1032, which pertains to the military being required to take custody of individuals.

“Confusingly, Obama threatened a veto for 1032, but NOT 1031. 1032 is UNRELATED to imprisoning citizens without a trial. Obama has never suggested using a veto to stop Section 1031 citizen imprisonment,” writes Wood.

•The notion that the administration lobbied for language that would have protected American citizens and legal residents from indefinite detention to be removed from the bill is unsurprising given Obama’s policy with regard to predator drone strikes.

The White House has asserted the right to carry out state-sponsored assassination anywhere in the world without having to provide any evidence or go through any legal process. The administration merely has to state that the target is a terrorist and it doesn’t matter whether they are an American citizen or not, as we saw in the case of American-born Anwar al-Awlaki and his son [2] who were both killed earlier this year.

Indeed, at the start of the month, Obama administration lawyers reaffirmed their backing [3] for state sponsored assassination.

Congress has until tomorrow to block the law before it heads to President Obama’s desk. Putting faith in an administration that has formalized state-sponsored assassination of U.S. citizens without trial to block the ‘indefinite detention’ provision of the NDAA bill is naive to say the least.

Dear brothers and sisters. Now is the time to open your eyes!

In a stunning move that has civil libertarians stuttering with disbelief, the U.S. Senate has just passed a bill that effectively ends the Bill of Rights in America.

The National Defense Authorization Act is being called the most traitorous act ever witnessed in the Senate, and the language of the bill is cleverly designed to make you think it doesn't apply to Americans, but toward the end of the bill, it essentially says it can apply to Americans "if we want it to.

Bill Summary & Status, 112th Congress (2011 -- 2012) | S.1867 | Latest Title: National Defense Authorization Act for.

This bill, passed late last night in a 93-7 vote, declares the entire USA to be a "battleground" upon which U.S. military forces can operate with impunity, overriding Posse Comitatus and granting the military the unchecked power to arrest, detain, interrogate and even assassinate U.S. citizens with impunity.

Even WIRED magazine was outraged at this bill, reporting:

The passage of this law is nothing less than an outright declaration of WAR against the American People by the military-connected power elite. If this is signed into law, it will shred the remaining tenants of the Bill of Rights and unleash upon America a total military dictatorship, complete with secret arrests, secret prisons, unlawful interrogations, indefinite detainment without ever being charged with a crime, the torture of Americans and even the "legitimate assassination" of U.S. citizens right here on American soil!

If you have not yet woken up to the reality of the police state we've been warning you about, I hope you realize we are fast running out of time. Once this becomes law, you have no rights whatsoever in America. — no due process, no First Amendment speech rights, no right to remain silent, nothing.

The US senate does not want us to speak. I suspect even now orders are being shouted into telephones and men with guns will soon be on their way. Why? Because while the truncheon may be used in lieu of conversation, words will always retain their power. Words offer the means to meaning and for those who will listen, the enunciation of truth. And the truth is, there is something terribly wrong with this country, isn't there?
Cruelty and injustice...intolerance and oppression. And where once you had the freedom to object, to think and speak as you saw fit, you now have censors and systems of surveillance, coercing your conformity and soliciting your submission. How did this happen? Who's to blame? Well certainly there are those who are more responsible than others, and they will be held accountable. But again, truth be told...if you're looking for the guilty, you need only look into a mirror.

I know why you did it. I know you were afraid. Who wouldn't be? War. Terror. Disease. There were a myriad of problems which conspired to corrupt your reason and rob you of your common sense. Fear got the best of you and in your panic, you turned to the now President in command Barack Obama. He promised you order. He promised you peace. And all he demanded in return was your silent, obedient consent.

More than four hundred years ago, a great citizen wished to embed the fifth of November forever in our memory. His hope was to remind the world that fairness. Justice, and freedom are more than words - they are perspectives. So if you've seen nothing, if the crimes of this government remain unknown to you, then I would suggest that you allow the fifth of November to pass unmarked. But if you see what I see, if you feel as I feel, and if you would seek as I seek...then I ask you to stand beside one another, one year from November 5th, 2011, outside the gates of every court house of every city DEMANDING our rights!!

With the approval from the Oval Office the only thing keeping a terrifying law that will allow for the indefinite detention and torture of Americans from passing, presidential hopeful Ron Paul has finally unleashed on the legislation.

Although President Barack Obama had originally insisted that he would veto the National Defense Authorization Act for Fiscal Year 2013, Senate Armed Services Committee Chairman Carl Levin revealed recently that the bill in its current wording was drafted after the current administration asked for changes.

Already making its way through the House and Senate, the Act in its current wording will allow for Americans suspected of any “belligerent” act to be detained in Guantanamo Bay-style military prisons indefinitely for any alleged crimes without trial. With it now being revealed that the president put forth suggestions to draft the latest version of the legislation, Levin told the press Monday night, "I just can't imagine that the president would veto this bill.”

"I very strongly believe this should satisfy the administration and hope it will,” added Levin.

Outside of the independent media, opposition to NDAA has remained almost nonexistent, with the mainstream neglecting to discuss the colossal implications the bill would have if it is signed into law. Speaking to radio host Alex Jones on Tuesday, however, Republican presidential hopeful Ron Paul finally became one of the first main figures to attack the act.

“This is a giant step – this should be the biggest news going right now – literally legalizing martial law,” said Paul. The congressman from Texas also appeared flabbergasted that the bill managed to escape discussion in any of the recent GOP debates, despite its provisions being detrimental to the US Constitution and the freedom of every man, woman and child in America.

“This is big,” continued Paul, adding “This step where they can literally arrest American citizens and put them away without trial….is arrogant and bold and dangerous.”

The bill could be on the desk of Barack Obama as early as Wednesday of this week.

Congressman Paul has been continuously critical of the Obama administration as of late, and although his fellow candidates for the GOP nomination have been equally as opt to attack the president, Paul has largely been the only one to tackle the sacrifice of civil liberties that Obama and the Republican Party frontrunners seem unconcerned with.

“Today it seems too easy that our government and our congresses are so willing to give up our liberties for our security,” Paul said during a presidential debate earlier this election season. “I have a personal belief that you never have to give up liberty for security. You can still provide security without sacrificing our Bill of Rights.”

Paul has also condemned the Patriot Act for crushing the freedoms of Americans, while top-tier candidate and former-House Speaker Newt Gingrich has insisted on finding a “balancing act between our individual liberties and security.”

If you haven't done so already, I suggest that you get involved with your local Tea Party or Oath Keepers groups. There are many people who want to fix the country and I believe many of them are involved in those two movements.
